EMPLOYMENT AGREEMENT
THIS EMPLOYMENT AGREEMENT is made this the 1st day of November, 2025 (Two Thousand Twenty Five)
BETWEEN
Nurul Islam Molla, son of Late Nurul Amin Molla, residing at R-183/C, SA Farooque Road, Kolkata - 700024, hereinafter referred to as the EMPLOYER.
AND
John Doe, son of Richard Roe, residing at 123 Elm Street, Springfield, hereinafter referred to as the EMPLOYEE.
WHEREAS the party to the first part is the sole and absolute owner of ALL THAT piece and parcel of one shop room measuring an area of 500 sq ft lying and situated at premises No. S-156/3, Cotton Mills Lane, Kolkata - 700018, which has been described fully and particularly in the Schedule hereunder.
AND WHEREAS the party to the first part being the sole and absolute owner of the Schedule property is running his business in the field of selling and repairing electrical goods and parts.
AND WHEREAS the party to the first part by virtue of the execution of this agreement has appointed the party to the second part as his employee in the said business at the Schedule property on the terms and conditions as setforth hereunder:-
Terms and Conditions
- The party to the second part shall run the business of the party to the first part from the schedule property for the period of November 01, 2025 to September 30, 2026;
- The party to the second part shall pay basis towards profit incurred from the business of the party to the first part;
- The party to the second part shall be liable to make the payment of the electricity bill and all other expenses which shall be necessary for smooth running of the business;
- If the party to the second part defaults for a single in making payment of the profit to the party to the first part, then the party to the second part shall be liable to hand over possession of the schedule property within 15 days therefrom;
- The party to the second part shall reside in the schedule property only for the sole purpose of smooth running of the business owned by the party to the first part for 24 hours and such in no manner whatsoever the party to the second part shall have right of residence in the schedule property;
- In case of demise of the party to the second part, any heir / heirs / legal representatives / assigns / constituted attorney shall not have any right / rights in the suit property;
- The party to the second part shall not store any exhaustible and/or life harming materials and/or any other material which is banned by any Government authority in the schedule property and if any such material/s is found, then the party to the second part shall be liable;
- The party to the second part shall not change the nature and character of the business;
- The party to the second part shall not do or caused to be done any act / deed which is against the law of the land;
- The party to the second part shall not create any third party interest and/or part with possession the schedule property;
AND WHEREAS the parties herein shall be bound to obey and comply the aforesaid terms and conditions.
AND WHEREAS the parties herein have entered this present without any fraud, coercion, undue influence and misrepresentation.
